1. Purpose 

The purpose of these General Terms and Conditions of Sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller sells and delivers the ordered products, and, on the other hand, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales by NUHANCIAM S.A.S. of the products offered on its website www.nuhanciam.com. 
Consequently, the act of any person ordering a product offered for sale on the website www.nuhanciam.com implies full and unconditional acceptance of these General Terms and Conditions of Sale, which the Buyer acknowledges having read prior to placing their order. Any terms and conditions other than those set forth herein shall be binding on the seller only upon written confirmation by the seller. The general terms and conditions of sale may be modified at any time without notice, provided they are posted on our sales website, and take effect immediately upon such posting. 

  

2. Products 

The photographs, graphics, and descriptions of the products offered for sale are for illustrative purposes only. NUHANCIAM S.A.S. shall not be held liable under any circumstances for any errors that may appear therein. 

  

3. Order 

Automatic registration systems are considered proof of the nature, content, and date of the order. NUHANCIAM S.A.S. will confirm acceptance of the order to the customer at the email address provided by the customer. The sale will not be finalized until the order is confirmed. NUHANCIAM S.A.S reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order. The information provided by the buyer when placing the order is binding: in the event of an error in the recipient’s contact information, the seller shall not be held liable for any inability to deliver the product. For any order equal to or exceeding 250 euros, you will be asked to provide a form of identification. 

  

4. Price 

The price is listed in euros. 
The price listed on the product pages does not include shipping.
The price indicated in the order confirmation is the final price, inclusive of all taxes and including VAT for France and EEC countries. This price includes the cost of the products, handling, packaging, and storage fees, as well as shipping and setup costs. 
For orders shipped to a country other than mainland France, you are considered the importer of the product(s) in question. Customs duties, local taxes, import duties, or purchase taxes may be required. These duties and fees are not the responsibility of NUHANCIAM S.A.S. but are the responsibility of the buyer. All orders, regardless of their origin, are payable in Euros. NUHANCIAM S.A.S. reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time the order is placed. The products remain the property of NUHANCIAM S.A.S. until full payment of the price has been received. 

  

5. Payments 

Payment must be made by the Buyer at the time of placing the online order. Under no circumstances shall the amounts paid be considered a deposit or down payment. 
All orders are payable in euros 
To pay for their order, the Buyer may use PayPal. 
The Buyer warrants to NUHANCIAM S.A.S. that they have the necessary authorization to use the payment method they have chosen when submitting their order form. 
NUHANCIAM S.A.S. reserves the right to suspend or cancel any order and/or delivery, regardless of its nature or stage of fulfillment, in the event of non-payment of any amount owed by the Buyer, in the event of a payment issue, or in the event of fraud or attempted fraud related to the use of the NUHANCIAM S.A.S. website. 
Penalties equal to the legal interest rate plus five percentage points shall automatically apply to any unpaid amounts ten days after the invoice date or upon notification of a rejected bank payment for any other payment method. Delivery of any new order may be suspended in the event of a late payment on a previous order, notwithstanding the provisions herein. 

  

6. Delivery 

NUHANCIAM S.A.S. will use its best efforts to ensure that the order is shipped within an average of ten (10) business days from the day following the Buyer’s confirmation of the order. The items ordered will be shipped to the delivery address you provided during the ordering process. The delivery method for mainland France is Colissimo, for French overseas departments and territories (DOM-TOM) it is Colissimo Outre-Mer, and for international shipments it is Colissimo International. Delivery takes 4 to 5 days for mainland France and between 7 and 15 days for DOM-TOM and international destinations, depending on the location. If you are not home or if your mailbox is not suitable, you will receive a delivery notice and your package will be held at your local post office. In the event of an unusual delay, such as a stock shortage, you will be notified by email. 
In any case, the Products will be shipped via standard postal services. NUHANCIAM S.A.S. therefore accepts no liability for excessive delivery delays caused by postal services or transportation providers, nor for the loss of ordered Products or strikes. Transportation risks are borne by the Buyer, who must file a formal complaint with the postal service or the carrier within three business days of delivery. Furthermore, it is specified that ownership of the ordered Products will not be transferred to the Buyer until full payment of the invoiced price has been made, including delivery charges. 
 
Delivery issues caused by the carrier. 
Any issue regarding the delivery (damage, missing items compared to the delivery slip, damaged package, broken products, etc.) must be clearly noted on the delivery slip in the form of “handwritten reservations,” accompanied by the customer’s signature. The customer must also confirm this issue by sending the carrier, within two (2) business days following the delivery date, a registered letter with return receipt requested setting forth the aforementioned claims. The customer must send a copy of this letter by regular mail to:

7. Right of Withdrawal 

Products must be returned to NUHANCIAM S.A.S. in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), properly sealed, and accompanied by the signed return form in accordance with the procedure described in Section 7.5 above. 
If the above conditions are met, a refund will be issued within 15 days of receipt of the package. 

  

8. Product Returns and Refunds 

Products may be returned by the Buyer in accordance with the terms and instructions below: 
Products must be returned to NUHANCIAM in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), properly sealed, and accompanied by the signed return form. This return form is available upon request by sending an email to contact@nuhanciam.com.
NUHANCIAM S.A.S. accepts returns of any item purchased on the website provided it is returned within 14 days of the date the Buyer received the order. 
In principle, the shipping costs for the return package are the responsibility of the Buyer. In the event of a technical defect or an error in the items delivered, the return shipping costs will be reimbursed by NUHANCIAM S.A.S. 
 
To return an item, the Buyer must follow these instructions: 
1. Use the original packaging to return the product. 
2. Fill out and include the Return Form, which can be detached from the Delivery Note. Returns without a Return Form will not be accepted. 
3. Send the package to the following address:

All risks associated with returning the product are the responsibility of the Buyer. 
Failure to comply with the procedure outlined above and the specified deadlines will preclude the Buyer from making any claim for non-conformity or apparent defects in the delivered products, as the products will then be deemed to be in conformity and free from any apparent defects. 
 
Upon receipt of the products, a refund will be issued within 10 business days to the original payment method. 

  

9. Retention of Title 

NUHANCIAM S.A.S retains full ownership of the products sold until full payment has been received, including the principal amount, fees, and taxes. 

 

10. Liability 

NUHANCIAM S.A.S. shall not be held liable for any failure to perform the contract in the event of a stock shortage or product unavailability due to force majeure, disruption, or a total or partial strike, particularly involving postal services, transportation, and/or communications. 
NUHANCIAM S.A.S. shall not be held liable for any indirect damages that may arise from the purchase of the products. 
NUHANCIAM S.A.S. shall not be liable for any loss of data or files. It is the Buyer’s responsibility to perform all necessary backups. 
NUHANCIAM S.A.S. disclaims all liability: 
- for any interruption of the website; 
- for any bugs that may occur; 
- for any inaccuracies or omissions in the information available on this site; 
- for any damage resulting from fraudulent intrusion by a third party that has led to a modification of the information made available on the site; 
- and more generally, for any direct or indirect damage, regardless of its causes, origins, nature, or consequences, including, in particular, costs that may arise from the purchase of goods offered on the site, loss of profits, customers, data, or any other loss of intangible assets that may arise from anyone’s access to the site, the inability to access it, or reliance on any information derived directly or indirectly from it. 

 

11. Intellectual Property 

In accordance with the laws governing copyright and other similar rights, this Website and all elements, trademarks, designs, logos, graphics, etc., contained on this Website, as well as their compilation, are the exclusive property of NUHANCIAM S.A.S., which grants no license or any right other than the right to view the Website. 
The reproduction or use of all or part of these elements is authorized solely for informational purposes for personal and private use; any reproduction or use of copies made for other purposes is expressly prohibited. Any other use constitutes an infringement and is punishable under intellectual property law, unless prior written authorization has been obtained from NUHANCIAM S.A.S. 

  

12. Export 

Subject to the rules applicable within the EEC and unless otherwise agreed by our company, the resale of NUHANCIAM products and acceptance of the general terms and conditions of sale imply the buyer’s commitment to sell the products only in the country to which they were shipped by our company. 

  

13. Governing Law and Jurisdiction 

Sales of products by NUHANCIAM S.A.S. are governed by French law. Any dispute relating to the interpretation, performance, or termination of the contract between NUHANCIAM S.A.S. and the Buyer, even in the event of multiple defendants, shall, in the absence of an amicable settlement, fall within the exclusive jurisdiction of the courts of Paris.

 

14. Data Protection 

The information collected by NUHANCIAM S.A.S. when the Buyer places an order is necessary for NUHANCIAM S.A.S. and its business partners to process the order. In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, the Buyer has the right to access, correct, object to, and delete data concerning them by contacting NUHANCIAM S.A.S. through customer service:
